Faroty, a limited liability company under Cameroonian law, with a capital of 10,000,000 FCFA, headquartered in Douala, Bonamoussadi, registered in the Douala Trade Register under number RC/DLN/2022/B/576 and identified by NIU M032217211519U (hereinafter "Faroty"), operates the website under the brand name Faroty, accessible at www.faroty.com (the "Site"), as well as several web and mobile applications related to its services.

Definitions

1. Purpose of the Terms

The purpose of these general terms of use is to define the rules for using the services provided by Faroty.

Faroty acts as an intermediary between users wishing to create a group, a money pot, or participate in money pots for charitable or private purposes, while providing a secure online service under the conditions set forth herein.

Faroty simplifies the collection, management, and processing of payments via Mobile Money, bank cards, and PayPal that may be carried out for the benefit of individuals or legal entities through technical solutions implemented by itself.

These services notably include:

• Crowdfunding: a collaborative financing platform allowing users to collect funds for personal, community, or associative projects.
• Group and Association Management App: ASSO+: an application allowing groups and associations to manage their activities, members, contributions, finances, and documents.
• Various Applications: specialized software tools for one-off or recurring needs, such as online ticket distribution, electronic voting systems, or activity management utilities.

These services are accessible via the website www.faroty.com and associated mobile/web applications.

2. Access and Registration

• Access to the services requires the creation of a user account via the website or one of the platform's mobile/web applications.
• To register, the user must:
  • Be at least 18 years old;
  • Possess a valid identification document issued by their country (ID card, passport, residence permit, etc.);
  • Provide accurate, complete, and up-to-date information during registration.
• Only one account is permitted per natural person or legal entity.
• By registering, the user expressly accepts these general terms of use.

3. Content

3.1. Prohibited Activities and Content

Faroty acts in the interest of its User community. To maintain a secure, open, and ethical service, certain content or money pot objectives are strictly prohibited. Prohibited items include, but are not limited to:

• Any content or project contrary to public order, current laws, or morality;
• Insulting, defamatory, sexist, revisionist, threatening language, or language inciting harassment;
• Attacks on human dignity, or the physical or moral integrity of any person;
• Apology for terrorism, crimes against humanity, or incitement to criminal acts;
• Projects financing terrorism, human trafficking, corruption, or criminal activities;
• Campaigns promoting hate, sexual or gender-based violence, or child pornography;
• Projects related to weapons, ammunition, drugs, tobacco, CBD, or regulated substances;
• Violations of copyright, image rights, intellectual property, or the right to privacy;
• Erotic, sexual, or pornographic content, or content inciting prostitution or escorting;
• Gambling, betting, pyramid schemes, or unregulated crypto-assets;
• Election campaigns, disinformation sites, or any activity deemed unacceptable by Faroty;
• Financing of fines or penalties, except for legal fees with supporting documentation;
• Any other activity likely to harm the reputation, security, or liability of Faroty or its Users.

3.2. Posting Content

Each User may publish information related to their money pot. Faroty does not provide remuneration for publishing content. Such content is the sole initiative of the User.

The User guarantees they hold the necessary rights to publish the content (copyright, image rights, etc.).

Faroty does not exercise systematic prior control. The User acknowledges that:

• Faroty is not responsible for published content;
• Faroty does not guarantee the accuracy, quality, or relevance of the content;
• Faroty disclaims all liability for inappropriate or illegal content.

A reporting system is available to Users to signal any abuse.

3.3. Reporting Illegal Content

Any User or Visitor may report illegal or inappropriate content. Such reports must be justified.

As soon as content is reported regularly, Faroty will proceed with its removal if it is manifestly illegal and will inform authorities if necessary.

Faroty may suspend or delete without notice:

• Any content contrary to these terms or current laws;
• Discriminatory, hateful, defamatory, or violent language;
• Content reported or subject to judicial decisions;
• Content harmful to Faroty's image or reputation;
• Unauthorized commercial activities.

Faroty shall not be held liable for the consequences of removing such content.

3.4. Deletion of Content

The User may delete content they have published themselves, if technically possible.

Faroty undertakes not to keep deleted content longer than necessary for technical removal and legal obligations.

Faroty shall not be held liable if deleted content has been copied by other users.

4. Personal Data

Faroty collects and processes personal data in accordance with current legislation. Collected data is used solely to provide the services offered and to ensure their security.

Users may at any time access their data, modify it, or request its deletion via their personal space or by contacting support.

5. Security and Confidentiality

Faroty implements all necessary technical measures to ensure the security of data and transactions. Communications are encrypted, and payments are secured via authorized partners.

Users are responsible for the confidentiality of their password and undertake to report any unauthorized use of their account.

6. Limitation of Liability

Faroty cannot be held liable for indirect damages suffered by the user due to the use of the site or services (loss of opportunity, loss of data, commercial harm, etc.).

Faroty does not guarantee the absence of errors or the continuous accessibility of its services, although it strives to maintain their availability.

7. Account Suspension and Deletion

Faroty reserves the right to suspend or delete an account in the event of non-compliance with the TOU, proven fraud, or suspicious activity. The user will be informed by email prior to any action, except in cases of force majeure or emergency.

8. Intellectual Property

All elements of the site and applications (texts, logos, images, source codes, etc.) are the exclusive property of Faroty. Any reproduction or distribution without authorization is strictly prohibited.

9. Applicable Law and Jurisdiction

These TOU are governed by Cameroonian law. Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of the courts of Douala.

10. Advertising and Promotion

Faroty reserves the right to offer users sponsored content or promotional communications concerning its own services or those of its partners, in compliance with applicable legislation.

Users may at any time refuse to receive commercial communications via their account settings or by following the unsubscribe link provided in messages.

11. Duration of Relationship - Termination

11.1. Duration

These general terms apply throughout the duration of the site's use and until the profile is deleted for any reason.

11.2. Profile Deletion

The user may at any time request the cancellation of a resource (group, money pot, collection, page, etc.) as well as the deletion of their profile. To do so, they must send their request by email to Faroty's customer service. Profile deletion leads to the deactivation of the identifier. Any other user may request the deletion of their own profile under the same conditions.

In the event of non-performance or non-compliance by the user with any of the obligations provided herein, Faroty may modify, suspend, limit, or delete access to its platforms within 10 (ten) days following a formal notice sent by email to the user that remains unheeded, without the user being able to claim any compensation, and without prejudice to the damages and interests that Faroty might claim.

In the event of a serious breach of any provision of these general terms, Faroty may immediately and without notice delete the user's profile, without compensation and without prejudice to available remedies.

Where applicable, ongoing money pots may be stopped, and contributions refunded to the concerned participants after deduction of due fees, rendered immediately payable by the termination.

12. Modifications to the TOU

Any modification to these general terms and/or services will be notified to the user by email ten (10) days before they come into effect and will be made available on the site. If the user refuses these modifications, they must delete their profile or contact customer service. Any use of the site after notification constitutes acceptance of the new general terms.

Faroty also reserves the right to modify the TOU at any time for technical, legal, or security reasons. In such cases, modifications will take effect immediately upon notification to the user.

Previous versions can be provided to the user upon request to the customer service email address.
